The gap had closed BECAUSE of the Voting Rights Act. Prior decisions limiting the Act have already had a negative effect.

The statement is ridiculous and fanciful on its face, but I wonder who Alito thinks he's talking to? He can't be worried about his posterity, that ship has already sailed. Maybe he's feeling a little guilty, though I doubt that. Maybe he wants to be respectable? It's a bit late for that.

Conservatives have long claimed that adverse rulings were made by “activist judges”. Unelected judges deciding that we don’t need a law that was passed by Congress 60+ years ago seems pretty activist.
