My piece in the NYT: if you feel like companies are increasingly beyond the reach of the law, it’s because they are. You are signing away your right to ever sue them if they cheat, discriminate, or even kill you. And it’s all thanks to the Supreme Court. www.nytimes.com/2026/05/01/o...
Did you see this nightmare? Guy's wife is poisoned to death at Disney park. Guy sues, but is forced to arbitration because he "agreed" to it by previously signing up for Disney+ Gift Article: www.nytimes.com/2026/05/01/o...

#MandatoryArbitration #ClassActionWaivers The Powell Memo has won. Our day in court is vanishing. We are being bled dry by corrupt corporate entities that boldly refuse to comply with the law and their contracts. #SupremeCourtMadeLaw #CourtReform #BanMandatoryArb www.nytimes.com/2026/05/01/o...
Big businesses shouldn’t be able to set their own rules and deny you access to justice. Consumer contract reform is an underrated democracy issue, but it *is* a democracy issue. Lot of stuff in routine click-through contracts can and should be made unenforceable.
He signed up for a Disney+ subscription and couldn't sue Disney World. Bizarre. (gift article) www.nytimes.com/2026/05/01/o...
"America has a hidden justice system. There, decisions are made in secret, and judges are often paid by the very companies they are supposed to judge. In any other system of justice, this would be called bribery. We call it forced arbitration,..." Gift link
We have to make corporations pay. Free read www.nytimes.com/2026/05/01/o...
“At businesses’ behest, the Supreme Court has empowered companies to compel their customers and employees into arbitration and made it all but impossible for ordinary judges to overturn those decisions — rendering our public justice system largely powerless to stop our private one.”
Forced arbitration is one of the things contributing greatly to enshittification. Because corporations know - no matter how bad things get you can’t do anything about it. & it’s one of those things Dems haven’t spoken about enough to craft a narrative with an enemy www.nytimes.com/2026/05/01/o...
Good lord, this story is harrowing.
Back in the '90s, one of Scalia's main projects was to rewrite the Arbitration Act. He casually (and thoroughly) accomplished it. In a slow news week, should there ever again be one), pls consider writing about how the Kochs et al were getting their money's worth. www.nytimes.com/2026/05/01/o...

A system of bribery and paid judges but keep up the myth that Americans have consumer or civil rights.

Wow. A disney restaurant killed his wife. But because they had a Disney+ subscription, they waived all liabilities for deadly experiences at Disney restaurants in Disney World, thanks to the T&Cs. Seems like a good reason to cancel Disney+. www.nytimes.com/2026/05/01/o...

Forced arbitration isn’t just legal fine print, it’s a rewrite of our rights. Jeffrey Picollo was blocked from suing after his wife’s death due to a Disney+ arbitration clause buried in the details when he subscribed. A scary, important piece from Brendan Ballou: www.nytimes.com/2026/05/01/o...

With help from the SCOTUS rulings, the tRump admin “is helping companies include forced arbitration clauses in their initial public offerings, making it functionally impossible for people to sue over corporate fraud.” www.nytimes.com/2026/05/01/o...

"Shining a light on how the court is putting big companies ever further beyond the reach of the law may force the justices to think twice before they continue down this path, and give states and cities time to act." #EndForcedArbitration #ProtectConsumers @nytimes.com www.nytimes.com/2026/05/01/o...
If citizens don't fight back our rights will be slowly and irreversibly eroded.
www.nytimes.com/2026/05/01/o... Another example of how evil American capitalism has become. We need to wrest control back from companies and return it to the people!

GIFT Because I want to watch the Bear on Hulu I can never sue Disney in open court when a Minnie Doll's head rolls off and my kid breaks a leg? (BTW I don't have a kid) Congress narrow those agreements that are 1000 pages long in 6 point font. www.nytimes.com/2026/05/01/o...

🎁 America has a hidden justice system. There, decisions are made in secret, and judges are often paid by the very companies they are supposed to judge. In any other system of justice, this would be called bribery. We call it “forced arbitration,” and… you are almost certainly bound by it.
